Information Regulator SA: Education Dept has Duty to Ensure Matrics Have Access to Results

The Information Regulator of South Africa said the Basic Education Department has a duty to ensure that the 2021 matric class have access to their results. 

The regulator said it notes the decision of the Basic Education Department to scrapp the publishing of matric results in newspapers and on digital platforms to comply with the Protection of Personal Information Act (POPIA).

The Regulator met with DBE on Wednesday to discuss the DBE’s approach in bringing the processing of personal information in compliance with POPIA act. 

In a statement, the regulator said POPIA makes provision for the safeguarding of personal information,

“It is the view of the Regulator that DBE has a duty to ensure that matriculants receive their results and that all matriculants can access the results in an appropriate manner. With regards to POPIA, a responsible party such as the DBE, is empowered to decide how to bring its actions or decisions in compliance with POPIA” 

The 2021 matric results are due to be announced on 20 January.
